The attached link is a New York Times article describing the recent experience of an NYPD officer who was cross-examined over material on his Facebook page. While the officer's posted comment thatthe movie "Training Day" was a good lesson in police procedure wasa joke, it did not play out that way in front of the jury. In a brilliant move, the defense attorney used the officerspublic postings to paint a picture of an overly aggressive officer willing to bend the rules.It was a simple gun case in which the defensewas that the officer planted the gun.The defendant was acquitted in what should have been a simple one-day trial leading to a quick guilty verdict. The Court's ruling permiting the use of the Facebook postingsfor cross examination wasentirely appropriate and legal - I believe theruling would have been the same in our courtrooms.As described in the article, the officer's postingsona variety of topics were extreme. However, for those of you who chose to use public forums on the Internet to express opinions, comment on your work, or share a few jokes with friends, be warned - the defense bar is watching and surfing the internet.
